My lawyer is not fighting for me as a frequent complaint that I get from new, potential clients. Some lawyers out there pretend to know about car accident and personal injury law but are sorely lacking in experience, knowledge, and negotiating ability. Make sure that the personal injury lawyer you choose has plenty of experience in handling your type of personal injury case.

Choose a specialist in car accident cases.

When choosing a car accident attorney, make sure that he or she has experience representing clients in car accidents involving injuries. Many attorneys advertise that they handle car accident cases but what you want is an attorney who specializes and only handles car accidents. You would not go to your family physician to replace your hip, you would go to a specialist, an orthopedic surgeon.

It is much the same when dealing with attorneys. Most attorneys essentially have a specialty, like personal injury, family law, wills and estates, real estate, etc. You want to find an attorney who really knows accident law and the laws surrounding personal injuries, such as fault, causation, and damages. I have been practicing exclusively personal injury and car accident law for the past 30 years plus. No one ever says about me that my lawyer is not fighting for me. I fight for my clients to the very end and get the best settlements humanly possible. So, if you say that my lawyer is not fighting for me, then give me a call.

I have personal injury experience from both sides: defending insurance companies and now exclusively representing injured victims. Over the years, I have honed my negotiating skills and am usually able to settle most cases that I take on. Only a very small minority of car accident cases end up in Court. Some lawyers are good talkers and good salespeople, but if you find that my lawyer is not fighting for me, ask your new car accident lawyer the following questions:

  • How Much Experience Do You Have In-Car Accident Or Motor Vehicle Accident Cases?

Very important question. You want to hire a car accident attorney who has a reputation for fighting for clients and has years and years of experience. Otherwise, you may end up concluding that my lawyer is not fighting for me.

  • How Long Have You Been Practicing Personal Injury And Car Accident Law?

I have more than 30 years of experience in only car accident and personal injury law. You do not want to hire a young attorney with little experience or a general lawyer who tries to handle personal injury or car accident cases on the side. Double digit car accident experience equals less complaints of my lawyer is not fighting for me.

  • Do You Only Take Car Accident And Personal Injury Cases?

If not, then stay away from this type of lawyer as they are not true specialists in personal injury law. Many complaints of my lawyer is not fighting for me is about attorneys who really do not know all the ins and outs of negotiating with insurance companies and the exact laws governing car accidents and personal injury cases.

  • Do You Personally Handle Each And Every Aspect Of My Car Accident Case?

I personally handle each and every aspect of your case and that is one reason that clients never tell me that my lawyer is not fighting for me. Many personal injury lawyers, especially in big law firms, do not personally handle your case. They normally have a paralegal do it (paralegals are not lawyers and did not go to Law School) or a junior attorney just out of law school. With this system of delegation, I see a lot of clients who come to me and say “my lawyer is not fighting for me”. They may not even every talk personally to their lawyer or even meet the lawyer as interviews are handled by paralegals.

  • How Many Personal Injury Cases Have You Settled?

I personally have settled thousands of personal injury and car accident cases in my career. You do not want to pick an attorney who has handled only a handful or only say a couple hundred personal injury cases.

  • My Lawyer Is Not Fighting Me Is A Very Good Reason To Switch To A Personal Injury Lawyer That Will Fight For You.

I put my neck on the line in every case that I handle. I usually get higher settlements than most car accident or personal injury lawyers because I only take a few cases at a time, work very hard on each case and I actually get to know my clients and talk to them every week. I may ask them how their medical treatments are going, do they need a referral for a particular diagnostic test or do they need to add additional doctors to their current regime.

  • Lawyer Fees Should Be Reasonable.

You also want to make sure that your accident attorney charges a contingency fee and not an hourly rate. All the best car accident attorneys will charge a contingency fee. A contingency fee is contingent upon the attorney getting a settlement for you and if he does, then he gets a percentage of the total recovery. I charge one of the lower contingency fees in Colorado because I want to see my clients get the most money in their pockets. I only charge 33% of the total settlement. Most attorneys charge between 33-50%. I believe that my clients should be properly compensated and the best way to do that is to put more money in the client’s pocket. One way I do this is to charge a low contingency fee to the client.

You do not want to hire an attorney right out of law school because they just do not have the legal experience to get you the highest settlement. As I explained above,  I am a veteran in my field. Always choose an attorney with adequate experience, at least 10 years or more of experience in handling accident cases. You would not want to hire a doctor who just graduated from medical school to operate on your heart, would you? It is the same thing with attorneys. Get the experienced attorney who knows how to handle your case because he has done it for many, many years.
